Random thoughts on Missouri's sunshine law written by a lawyer who has an undying interest in this subject which probably only interests a few other folks in this state.

The law applies down the line

On Friday, one of the newspapers in the state checked in to report that the local school board, in
taking votes in closed meetings, would first vote to see the outcome of the vote. And then, they
would put in the minutes that the vote was unanimous for whichever side won the vote.

Section 610.015 requires that all votes be recorded. So am I to assume this school board is
recording a false act in its minutes? Clearly, that is not the vote that resulted from the call of the
roll of this board. Instead, in an effort to appear to be harmonious, the board is creating a fraud
on the public. And clearly breaking the stated mandate of the law.

The creativity of public bodies in ignoring the Sunshine Law some days is incredible
